APPLICANT PRIVACY NOTICE
Pursuant to the California Consumer Privacy Act of 2018 and the California Privacy Rights Act of 2020 (the “California Privacy Laws”), Bandai Namco Entertainment America Inc. (“BNEA,” “we” or “us”) is providing the following details regarding the categories of Personal Information that we collect, use, and disclose about California residents. This Applicant Privacy Notice (the “Applicant Privacy Notice”) applies to job applicants and individuals interested in potential employment opportunities at BNEA. Under California Privacy Laws, “Personal Information” is information that identifies, relates to, or could reasonably be linked with a particular California resident or household.
Sources of Personal Information
We collect Personal Information from:
- Your interactions with us, such as when you disclose information to us during the recruitment, application, and interview process, input personal information in any of our websites, systems, or application forms, or upload your resume or cover letter to a job posting,
- Third party service providers such as recruiters and job boards;
- Any sources directed by you; and
- Publicly available sources.
Categories of Personal Information Collected
We collect, and have collected within the preceding twelve (12) months, the following categories of Personal Information as listed in the California Privacy Laws:
- Identifiers, such as name, preferred name, postal address, unique personal identifiers, online identifier, telephone number, IP address, email address, driver’s license or state identification card number, date of birth, or other similar identifiers;
- Personal information, as defined in the California customer records law, such as name, signature, address, telephone number, driver’s license or state identification card number, education, employment, or employment history;
- Characteristics of protected classifications under California or federal law, such as age, gender, ethnicity, race, marital status, medical conditions, citizenship status, or veteran status;
- Internet or other electronic network activity information, such as interactions with our systems and sites;
- Geolocation data, such as time and physical location related to physical access to our office;
- Audio, electronic, visual, thermal, and similar information, such as photographs and audio and video recordings;
- Professional or employment-related information, such as work history and prior employment;
- Education information subject to the federal Family Educational Rights and Privacy Act, such as degree information; and
- Sensitive personal information as defined in the California Privacy Laws such as driver’s license or state identification card numbers.
Use of Personal Information
We use this Personal Information for the purposes of operating, managing, and maintaining our business, managing our workforce, and accomplishing our business purposes and objectives, including, for example, using Personal Information to:
- Manage workforce activities and personnel generally, including for recruitment and onboarding purposes;
- Perform identity verification; and
- Comply with law, legal process, internal policies and other requirements such as record-keeping and reporting obligations, and to exercise and defend legal claims.
Disclosure of Personal Information
We have disclosed the following categories of Personal Information as listed in the California Privacy Laws to third parties for our operational business purposes within the preceding twelve (12) months:

We have disclosed these categories of Personal Information to our affiliated entities, trusted third-party services providers, governmental authorities (as required by law or legal process), and professional advisors such as auditors and law firms.
We have not “sold” or “shared” Personal Information for purposes of California Privacy Laws.
For purposes of this Applicant Privacy Notice, “sold” or “sale” means the disclosure of Personal Information for monetary or other valuable consideration but does not include, for example, the transfer of Personal Information as an asset that is part of a merger, bankruptcy, or other disposition of all or any portion of our business. Whereas “share,” “shared,” or “sharing” means sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, Personal Information by the business to a third party for cross-context behavioral advertising, whether or not for monetary or other valuable consideration, including transactions between a business and a third party for cross-context behavioral advertising for the benefit of a business in which no money is exchanged.
Data Retention
Information covered under this Applicant Privacy Notice will be retained by BNEA for as long as needed or permitted considering the purpose(s) for which it was obtained.
BNEA uses the following criteria to determine the retention periods:
- The length of time an applicant has an active relationship with BNEA. For example, BNEA will retain Personal Information for so long as the applicant is being considered for employment. If hired, we will retain your Personal Information as a part of your employment record and for as long as you are employed by BNEA.
- The length of time that it is necessary to hold that Personal Data in connection with purposes set out in this Applicant Privacy Notice.
- Whether BNEA has a legal or business obligation to retain such information.
- Whether BNEA retains some Personal Information to protect itself against legal claims or to continue to process Personal Information in relation to any ongoing legal claim.
- When deciding the duration that BNEA retains Personal Information, we will take into account:
- The applicable limitation period under applicable law (i.e. any period during which any person could bring a legal claim against BNEA); or
- an additional reasonable period following the end of such applicable limitation period.
Individual Rights and Requests
If you are a California resident, you have the following rights:
- The right to disclose to you the following information covering the twelve (12) months preceding your request:
- The categories of Personal Information we collected about you and the categories of sources from which we collected such Personal Information;
- The specific pieces of Personal Information we collected about you;
- The business or commercial purpose for collecting Personal Information about you; and
- The categories of Personal Information about you that we otherwise disclosed, and the categories of third parties with whom we shared or to whom we disclosed such Personal Information (if applicable).
- The right to delete Personal Information we collected from you;
- The right to correct inaccurate Personal Information;
- The right to not be discriminated for exercising your rights under the California Privacy Laws.

BNEA may need additional information to verify your identity, in which case, BNEA will contact you to request for that information. You may also designate an authorized agent to make the aforementioned requests, in which case, BNEA will contact the authorized agent for additional information.
Response Timing
BNEA will make efforts to respond to a verifiable request within forty-five (45) days of its receipt. If we determine that we need more time, we will inform you of the reason and extension period in writing.
Changes to this Applicant Privacy Notice
We may change or update this Applicant Privacy Notice from time to time. When we do, we will post the revised Applicant Privacy Notice on this page with a new “Last Updated” date.
