LIVE EVENT TERMS & CONDITIONS
IMPORTANT: THE TERMS SET FORTH IN THESE LIVE EVENT TERMS & CONDITIONS (“TERMS”) GOVERN YOUR INVITATION TO, ATTENDANCE AT, OR PARTICIPATION IN AN EVENT OR ACTIVITY RELATING TO BNEA OR ITS AFFILIATES’ OWNED OR CONTROLLED PRODUCTS OR SERVICES (THE “EVENT”) WHERE THESE TERMS ARE LINKED OR OTHERWISE PRESENTED TO YOU. BY ATTENDING OR PARTICIPATING IN THE EVENT, YOU HEREBY ACKNOWLEGE AND AGREE TO THESE TERMS, WHICH FORMS A LEGALLY BINDING AGREEMENT BETWEEN YOU AND BANDAI NAMCO ENTERTAINMENT AMERICA INC. (“BNEA”).
Epilepsy warning: A small percentage of the population may experience episodes associated with epilepsy, such as seizures or sudden loss of awareness, when exposed to certain visual images that may appear throughout the Event. If you or anyone in your family has suffered from such epileptic episodes, please consult your physician before you attend the Event. Please immediately leave the Event and consult your physician if you experience any of the following symptoms: dizziness, disorientation, loss of consciousness or awareness, convulsions, sporadic jerking movements of arms or legs, muscle stiffness, or eye twitching.
COVID-19 Notice: Participation in the Event shall be at your own risk. You acknowledge and understand that there is a risk of being exposed to or contracting COVID-19 (as defined by the World Health Organization) and any strains, variants, or mutations thereof (“COVID-19”) during or in connection with the Event. You acknowledge and expressly assume the risk that you may be exposed to COVID-19 and the associated dangers, medical complications (including death) and physical and mental injuries, and associated economic losses, both foreseen and unforeseen, that may result from contracting COVID-19.
Please do not attend the Event:
- If, in the past 24 hours, you have experienced any of the following symptoms:
- Cough, shortness of breath, fever (100.4° F or above), chills, fatigue, muscle aches and pains, sore throat, headaches, new loss of taste or smell.
- If, within the past 48 hours, you have had close contact with an individual who tested positive for, or was diagnosed with, COVID-19.
- If you are currently awaiting COVID-19 test results due to an exposure or are experiencing symptoms.
Assumption of Risk. To the extent applicable, You acknowledge that Your participation in the Event may involve certain inherent risks of physical activity and possible injury that cannot be eliminated regardless of the care taken to avoid injuries.
License: You hereby irrevocably grant to BNEA and its affiliates a non-exclusive, irrevocable, fully-paid, royalty-free, assignable, sublicensable, worldwide license to use your name, image, likeness, voice, and any feedback, suggestions, concepts, or other information owned or controlled by you as may be recorded or collected during or in connection with the Event (collectively, the “Materials”), in perpetuity, in all media now known or hereinafter devised, for value received and without further consideration or compensation. You acknowledge and agree that nothing herein shall obligate BNEA to use the Materials or exercise any rights granted herein. You further acknowledge and agree that BNEA and/or its nominees own or control all such content or materials, including all intellectual property rights, subject to the license granted by you to any Materials incorporated therein.
Release: You hereby release, forever discharge, and agree to hold harmless BNEA, its parent company, affiliates, licensors, licensees, contractors, and their respective, officers, directors, shareholders, agents, and employees (collectively, the “Releasees”) from and against any liability for any and all claims, demands, losses, and liabilities of any nature and waive, to the fullest extent permitted by law, any cause of action in law or equity you may have or may acquire against the Releasees or any of them including without limitation, any claims for libel, slander, invasion of privacy, copyright or trademark violation, right of publicity, or false light arising out of or in connection with the utilization by the Releasees of the Materials, or any personal injury that may occur during, as a result of, or in connection with the Event.
Governing Law and Jurisdiction: You acknowledge and agree that any claims related to the Event will be governed and construed under the laws of the State of California, without application of conflict of laws principles and consent to exclusive jurisdiction of the state or federal courts located in Los Angeles County, California.
